Terms and Conditions - Landscapers Honoroak
Welcome to the Terms and Conditions for Landscapers Honoroak. This page explains the rules, expectations, responsibilities, and limitations that apply when you use our landscaping services. By engaging our services, requesting a quote, booking a project, or otherwise proceeding with work, you agree to the terms outlined here. These terms are designed to create clarity, protect both parties, and help ensure a smooth, professional working relationship.
Because landscaping projects can vary widely in scope, timing, materials, and site conditions, it is important to understand how our service process works. The information below covers project scope, estimates, payments, scheduling, client obligations, property access, materials, changes to work, cancellations, warranties, and liability. This content is written to be clear and practical while remaining informative and easy to understand.
1. Acceptance of Terms
When you request landscaping services from Landscapers Honoroak, you acknowledge that you have read, understood, and accepted these terms and conditions. If you do not agree with any part of these terms, you should not proceed with booking or authorizing work. Acceptance may be expressed verbally, in writing, or through confirmation of an estimate or work order.
These terms apply to all standard landscaping services, including but not limited to lawn care, garden maintenance, planting, hedge trimming, turf installation, hardscaping, seasonal cleanups, and related outdoor improvement work. Any special or custom service may require additional terms specific to that project.
2. Scope of Services
The scope of each project will be defined in the estimate, proposal, or work order provided before work begins. It is the client’s responsibility to review the scope carefully. Only the tasks listed in the approved scope are included, unless additional work is specifically agreed upon later.
Landscaping work may involve design, preparation, installation, maintenance, repair, or removal of outdoor features. Depending on the project, services may include soil preparation, edging, mulching, planting, sod laying, pruning, irrigation adjustments, gravel placement, pathway work, or seasonal yard care. The final scope may change based on site conditions, weather, materials availability, or client requests.
Any work not explicitly included in the agreed scope is considered extra work and may result in additional charges. This includes changes requested after the project starts, unforeseen repair needs, or issues discovered during service that were not visible during the estimate process.
3. Estimates and Pricing
All estimates are based on the information available at the time they are created. While we aim to provide accurate pricing, estimates are not guarantees unless specifically stated as fixed-price agreements. In many cases, landscaping work can be affected by variables such as soil conditions, hidden debris, plant health, access issues, slope, drainage problems, or weather disruption.
Pricing may change if the actual site conditions differ from what was initially observed or described. If additional labor, materials, or equipment are needed, the client will be informed whenever possible before further work continues. Estimates may also include labor, materials, disposal fees, and equipment use, depending on the project.
Unless otherwise stated, all prices are quoted in the applicable local currency and are subject to taxes where required by law. The client should carefully review whether the estimate includes or excludes taxes, delivery charges, permits, or special materials.
4. Payments and Billing
Payment terms will be outlined in the estimate, invoice, or service agreement. Some projects may require a deposit before work begins, especially for larger or custom landscaping installations. Deposits help secure scheduling and material purchases. In most cases, the remaining balance is due upon completion or according to the timeline stated on the invoice.
Accepted payment methods may vary by project, but all payments must be made in full and on time. Late payments may result in service delays, suspension of future work, or late fees where allowed. If payment is not received by the due date, Landscapers Honoroak reserves the right to pause work until the account is brought current.
If a payment is returned, reversed, or disputed without valid reason, the client may be responsible for any related administrative fees, banking charges, or collection costs. All billing questions should be raised as soon as possible so that they can be reviewed promptly.
5. Scheduling and Project Timelines
Project dates and times are scheduled based on availability, workload, weather, and material readiness. Although we make every effort to begin and complete projects on time, landscaping work is often affected by factors outside our control. These may include rain, extreme heat, frost, supplier delays, equipment issues, or emergency rescheduling of prior jobs.
Timeline estimates are approximate unless a firm completion date has been specifically agreed upon in writing. Delays caused by site conditions, missing approvals, or client-requested changes may extend the schedule. We will communicate meaningful changes when practical, but the client should understand that outdoor work is inherently subject to unpredictability.
If a client delays scheduling confirmation, material approval, or site access, the project may be moved to a later date. In high-demand seasons, rescheduling may take longer due to limited availability.
6. Client Responsibilities
To help ensure safe and efficient service, the client agrees to provide accurate information about the property and the requested work. This includes known hazards, underground utilities, irrigation systems, drainage concerns, pet restrictions, access limitations, and any relevant neighborhood or property rules.
The client is responsible for ensuring that the work area is reasonably clear of personal belongings, fragile items, toys, vehicles, and obstacles before service begins. Any items left near the work zone may be moved carefully if needed, but we are not responsible for damage to unsecured belongings.
It is also the client’s responsibility to obtain any required permissions, approvals, or permits if the project requires them and if they are not otherwise included in our agreement. If a homeowner association, landlord, or local authority has restrictions, the client should disclose them before work starts.
7. Site Conditions and Hidden Issues
Landscaping projects often involve outdoor surfaces and underground areas that may contain hidden risks. These can include rocks, roots, buried debris, old concrete, pipework, wiring, unstable soil, pests, or drainage obstructions. Such issues may not be visible during a standard estimate or initial visit.
If hidden conditions are discovered during the project, we may need to modify the plan, adjust the schedule, or recommend additional work. In some cases, the discovery of hazardous or unstable conditions may require pausing the project until the issue is addressed. We are not responsible for pre-existing site problems that are not caused by our work.
Because excavation, planting, grading, and installation work can affect the ground beneath the surface, the client acknowledges that some level of uncertainty exists in landscaping work and accepts that additional solutions may be necessary when unexpected conditions are found.
8. Materials, Plants, and Product Availability
Any materials, plants, soil, mulch, stone, or other products used in a project are subject to availability. Seasonal supply changes, weather impacts, and supplier inventory can affect what is obtainable at the time of service. If a chosen item becomes unavailable, a comparable alternative may be suggested.
Natural materials can vary in color, texture, size, and appearance. Plants may also differ from photographs or samples because of growth stage, seasonal condition, nursery stock, or environmental variation. This is normal and does not necessarily mean the product is defective.
Clients are encouraged to understand that living materials such as grass, shrubs, trees, and flowers require proper care after installation. Their long-term performance depends on watering, sunlight, soil condition, weather, and maintenance. While we select materials with care, natural outcomes cannot be guaranteed in every situation.
9. Changes to Work and Additional Services
Requests to change the project scope after work has started must be approved before implementation. Changes may affect cost, labor, timeline, and material requirements. If a client asks for extra tasks, expanded coverage, or a different design direction, those changes will be treated as additional work.
We may also recommend changes if we discover that the original plan is not suitable for the site conditions. In such cases, updated pricing or revised recommendations may be provided. Nothing should be assumed to be included unless it has been clearly agreed in writing or added to the revised scope.
If a project is significantly altered, a new estimate or change order may be issued. The client must approve the revised arrangement before the additional work proceeds whenever practical.
10. Cancellations and Rescheduling
Clients may request to cancel or reschedule a booking, but reasonable notice is expected. When a project is canceled after materials have been purchased or labor has been reserved, the client may be responsible for non-recoverable costs.
If weather, safety concerns, or other unavoidable issues require rescheduling, we will make a reasonable effort to find a new date. However, we do not guarantee immediate rebooking. Project timing may depend on availability and the nature of the delay.
Repeated last-minute cancellations or failure to provide access may result in the need for a new booking arrangement or a revised estimate. In some situations, deposits may be retained to cover administrative time, material preparation, or lost scheduling opportunities where permitted.
11. Property Access and Safety
The client must provide safe and reasonable access to the property and work area. Gates, driveways, side entrances, and utility areas should be accessible during the scheduled time. If access is blocked or unsafe, work may be delayed until the issue is resolved.
We take safety seriously and expect clients to notify us of any known risks such as aggressive animals, slippery surfaces, hidden hazards, or unstable structures. If conditions are unsafe for the crew or equipment, work may be stopped or postponed.
Children, pets, and bystanders should be kept away from active work zones. Landscaping equipment, tools, and materials can create injury risks. While we work carefully and professionally, the client shares responsibility for maintaining a safe environment around the project site.
12. Warranties and Natural Results
Some services may include limited workmanship expectations, depending on the project type and written agreement. However, landscaping involves natural materials and environmental variables that cannot always be controlled. As a result, guarantees may be limited or excluded for items such as plant survival, turf performance, color consistency, or weather-related damage.
Living landscapes are dynamic. Even when installed correctly, plants and lawn areas may be affected by drought, excessive rain, pests, disease, foot traffic, poor drainage, or improper care after completion. Any warranty or service guarantee will generally apply only to the specific workmanship terms stated in the project agreement.
Clients should follow recommended care instructions after installation. Failure to water, fertilize, prune, or protect plantings appropriately may affect results and may void any applicable warranty coverage.
13. Limitation of Liability
To the fullest extent allowed by law, Landscapers Honoroak is not liable for indirect, incidental, consequential, or special damages arising from the use of our services. This includes losses related to weather, plant failure, delays, pre-existing site conditions, or reliance on estimates that were subject to change based on actual conditions.
Our responsibility is generally limited to the value of the services provided, except where otherwise required by law. We are not responsible for damage caused by hidden defects, inaccurate site information, third-party interference, vandalism, severe weather, or client neglect after project completion.
This limitation helps reflect the reality of outdoor work, where conditions can shift quickly and outcomes may depend on many variables beyond human control.
14. Intellectual Property and Project Materials
Any sketches, plans, concepts, written proposals, or visual materials created for a project may remain the property of the provider unless otherwise agreed. These materials are prepared for use in connection with the project and may not be copied or reused without permission where applicable.
If a design or concept is developed specifically for the client, the client may use it for the approved project, but broader reproduction rights may remain restricted. Any branding, documents, or other protected content associated with Landscapers Honoroak must not be copied or distributed without authorization.
15. Changes to Terms
These terms and conditions may be updated from time to time to reflect operational changes, legal requirements, or service improvements. Updated terms may apply to future bookings or ongoing projects where appropriate. Clients are encouraged to review the latest version before confirming work.
If a specific project agreement conflicts with these general terms, the project agreement may take precedence for that project only. All other terms remain in effect unless replaced in writing.
16. Governing Expectations and Final Agreement
These terms are intended to promote transparency, fairness, and a professional service experience. Landscaping projects involve planning, physical labor, natural materials, and site-specific variables, so clear expectations are important for both the client and the service provider.
By proceeding with a project, the client agrees to communicate honestly, review all estimates carefully, respect scheduling requirements, and understand the limitations that come with outdoor work. In return, Landscapers Honoroak is committed to delivering quality workmanship, reasonable communication, and careful attention to the agreed scope.
In summary, these terms help establish a reliable foundation for landscaping services. They clarify what is included, what may change, how payment works, and how unexpected issues are handled. By setting these expectations early, both parties can focus on the project itself and work toward a successful outcome.
Thank you for taking the time to review these Terms and Conditions. Understanding them before work begins helps support a smoother process and a better overall result for your landscape project.
